The Website is operated by Transactworld Limited and Payment Infosys Limited (together referred to as “TWPayz”, “we”, “us” or “our”). Where these Terms refer to a particular regulated service, obligation or liability, the reference shall be to the relevant legal entity providing that service or to which the relevant obligation or liability applies.
Regulated services made available through the Website are provided by the relevant TWPayz entity, as described below:
Transactworld Limited, for customers located in the United Kingdom, is a company incorporated in England and Wales and is authorised and regulated by the Financial Conduct Authority as an Electronic Money Institution under the Electronic Money Regulations 2011, with Firm Reference Number 900405
Payment Infosys Limited provides payment services to customers outside the United Kingdom, where such services are available in accordance with applicable laws and regulatory requirements. Payment Infosys Limited is incorporated in Mauritius and licensed by the Financial Services Commission of Mauritius to provide Payment Intermediary Services under the Financial Services Act 2007.
The availability of the Website, and of any products or services described on it, may vary depending on your location. Nothing on the Website constitutes an offer or solicitation to provide any product or service in any jurisdiction where such offer or provision would be unlawful or where the relevant TWPayz entity is not authorised or permitted to provide it.
These Terms govern your access to and use of the Website only. They do not govern the provision of payment, electronic money, processing or other services provided by TWPayz (each a “Service”), which are subject to the applicable customer agreement, General Terms and Conditions and any product-specific terms. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to them, you must not access or use the Website.
1. General
1.1. The Website is made available free of charge for informational and legitimate business purposes, subject to these Terms. Our Privacy Notice explains how we collect and process personal data in connection with the Website. Our Cookie Notice explains how cookies and similar technologies are used on the Website and the choices available to you. Where you apply for, register for or use any TWPayz Service, separate General Terms and Conditions and product-specific terms will apply to that Service.
1.2. In the event of any inconsistency between these Terms and the terms governing a particular Service, the terms governing that Service shall prevail in relation to that Service.
1.3. We may amend these Terms from time to time, including to reflect changes to the Website, our business, applicable law or regulatory requirements. The revised Terms will take effect when published on the Website, unless a later date is stated. You should review these Terms periodically. Your continued use of the Website after the effective date of revised Terms constitutes acceptance of those revised Terms.
1.4. Any amendment to these Website Terms shall not amend any separate customer agreement or terms governing a TWPayz Service, unless such amendment is made in accordance with the provisions of that agreement and applicable law.
2. Use of Website
2.1. You must use the Website only for lawful purposes and in accordance with these Terms. You must not use the Website in any manner that violates any applicable law or regulation. You must not use the Website for:
a. Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws
b. Transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice
c. Interfering with any other person’s use or enjoyment of the Website
d. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
e. Introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, attempting unauthorized access to our Website, the server on which our Website is located or any server, computer or database connected to our Website, attacking our Website via a denial-of-service attack or a distributed denial-of service attack
f. Impersonating any person or entity, misrepresenting your identity or affiliation, or submitting false, misleading or fraudulent information
g. Using automated means, including bots, crawlers, scrapers or similar technologies, to access, extract or interfere with the Website, except where expressly permitted by us or applicable law
h. Attempting to circumvent security, authentication, access-control or technical measures implemented on the Website
i. Using the Website for fraudulent, unlawful or abusive purposes
2.2. Activities described above may constitute criminal offences under applicable cybersecurity and computer misuse legislation, including the UK Computer Misuse Act 1990 and the Mauritius Cybersecurity and Cybercrime Act 2021. Where appropriate, we may report suspected unlawful activity to the relevant law enforcement authorities and cooperate with any lawful investigation.
2.3. You are responsible for ensuring that all information you provide through the Website is accurate, complete, current and not misleading. You must promptly update any information where required in connection with your use of the Website or a TWPayz Service.
2.4. You are responsible for maintaining the confidentiality and security of your login credentials and other security information and must not disclose them to any unauthorised person. You must notify TWPayz promptly if you know or suspect that your credentials have been lost, stolen, disclosed, compromised or used without authority. TWPayz shall not be responsible for losses resulting from your failure to comply with these obligations, to the extent permitted by applicable law and the terms governing the relevant TWPayz Service.
2.5. To the extent permitted by applicable law, you will be responsible for any losses, liabilities, damages, costs and reasonable expenses incurred by TWPayz arising from or in connection with your breach of these Terms, misuse of the Website or violation of applicable law.
2.6. TWPayz may suspend, restrict or disable your access to the Website or any Website credentials where TWPayz reasonably considers this necessary due to a breach or suspected breach of these Terms, suspected fraud or misuse, security concerns, compromised credentials, legal or regulatory requirements, or for the protection of TWPayz, its customers or third parties.
TWPayz is not required to provide prior notice where doing so would be impracticable, unlawful or could compromise security, fraud prevention or an investigation.
2.7. The relevant TWPayz entity may restrict, suspend or refuse access to the Website, an application or any Website functionality where it reasonably considers this necessary for legal, regulatory, sanctions, financial crime prevention, fraud prevention, security or risk management purposes. Any restriction or suspension of a Service shall be governed by the terms applicable to that Service and applicable law.
3. Availability and Maintenance of Website
3.1. TWPayz may modify, suspend, withdraw, restrict or discontinue all or any part of the Website or any functionality available through it at any time where reasonably necessary for operational, security, legal, regulatory or business reasons. TWPayz does not guarantee that the Website or any content or functionality will always be available or uninterrupted, error-free or suitable for any particular purpose. This clause does not affect any rights or obligations arising under the terms governing a TWPayz Service.
3.2. Access to the Website or certain Website functionality may be temporarily restricted or unavailable from time to time due to scheduled or unscheduled maintenance, updates, repairs or the introduction of new or improved functionality. Where reasonably practicable, TWPayz will aim to minimise disruption to the Website.
3.3. Website-related enquiries may be submitted using the contact details provided on the Website. Complaints concerning a TWPayz Service should be submitted in accordance with the Complaints procedure applicable to the relevant TWPayz entity.
4. Third Party Websites
4.1. The Website may contain links to websites, services or resources operated by third parties. Such links are provided for information and convenience only. TWPayz does not control and, to the extent permitted by law, accepts no responsibility for the availability, accuracy, content, security, privacy practices, products or services of any third-party website or resource. The inclusion of a link does not constitute endorsement or approval by TWPayz.
4.2. Your use of any third-party website or service is at your own risk and subject to that third party’s applicable terms and policies.
4.3. References on the Website to any bank, card scheme, payment network, partner, service provider or other third party do not imply any endorsement, guarantee or assumption of responsibility by that third party unless expressly stated otherwise.
5. Linking to the Website
5.1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
5.2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists, and you must not establish a link to the Website from any website over which you do not have lawful authority or control. The Website must not be framed on any other site, nor may you create a link to any part of the Website other than the home page.
5.3. We reserve the right at any time and in our sole discretion, to block links to the Website through technological or other means without prior notice.

6. Intellectual Property Rights
6.1. Unless otherwise stated, all intellectual property rights in the Website and its content, including text, graphics, software, images, photographs, logos, trademarks, design, layout, databases and other materials, are owned by or licensed to TWPayz and are protected by applicable intellectual property laws.
6.2. Nothing in these Terms grants you any right or licence to use the TWPayz name, trademarks, logos, domain names or other intellectual property except with our prior written consent or as expressly permitted by applicable law.
6.3. You must not copy, reproduce, modify, republish, distribute, transmit, display, commercially exploit, reverse engineer or create derivative works from the Website or its content except with TWPayz’s prior written consent or where expressly permitted by applicable law.
6.4. All rights not expressly granted are reserved.
7. Disclaimer and Limitation of Liability
7.1. Content on the Website is provided for general information only. Although TWPayz may update the Website from time to time, TWPayz does not warrant or guarantee that Website content will at all times be complete, accurate, current, error-free or suitable for any particular purpose. Nothing in this clause limits any obligation of the relevant TWPayz entity to provide information required under applicable law or the terms governing a Service.
7.2. To the fullest extent permitted by applicable law, TWPayz excludes all representations, warranties and conditions, whether express or implied, relating to the Website and its content.
7.3. TWPayz shall not be liable for any indirect, incidental, special, punitive or consequential loss or damage arising out of or in connection with access to, use of, reliance on, or inability to use the Website.
7.4. Where the Website is used for business purposes, TWPayz shall not be liable, to the fullest extent permitted by applicable law, for any loss of profits, revenue, business, contracts, anticipated savings, data, goodwill, reputation or business opportunity arising out of or in connection with the Website.
7.5. TWPayz shall not be liable for loss or damage resulting from Website unavailability, interruptions, technical failures, third-party websites or services, malicious software originating from third parties, or events outside TWPayz’s reasonable control, except to the extent that such liability cannot lawfully be excluded or limited.
7.6. TWPayz does not guarantee that the Website will be completely secure or free from bugs, viruses or other harmful components. You are responsible for configuring your devices, systems and software appropriately and for using suitable security and virus-protection measures.
7.7. The Website and its content are provided for general information only and do not constitute any financial, legal, tax or other professional advice. You should obtain appropriate professional advice before taking or refraining from any action based on information available through the Website.
7.8. Nothing on the Website constitutes an offer, solicitation, recommendation, representation or commitment by TWPayz to provide any Service or enter into any transaction or business relationship. The availability and provision of any Service are subject to applicable laws and regulatory requirements, the eligibility and onboarding requirements of the relevant TWPayz entity, successful completion of any required due diligence, and acceptance of the customer terms applicable to that entity and Service.
7.9. Submission of an application, registration request or information through the Website does not guarantee that an account will be opened, a Service will be provided or a business relationship will be established. The relevant TWPayz entity may accept or decline applications in accordance with its applicable policies, eligibility and risk criteria, and legal and regulatory obligations.
7.10. Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
7.11. The exclusions and limitations in this clause relate to the Website and do not amend or replace any limitation of liability, responsibility or remedy expressly provided under the terms governing a TWPayz Service.
8. Law and Jurisdiction
8.1. These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by:
(a) The laws of England and Wales, insofar as they relate to Transactworld Limited
(b) The laws of Mauritius, insofar as they relate to Payment Infosys Limited
8.2. To the fullest extent permitted by applicable law:
(a) The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms insofar as it relates to Transactworld Limited
(b) The courts of Mauritius shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms insofar as it relates to Payment Infosys Limited
9. Severability
9.1. If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable or, where this is not possible, severed. The remaining provisions shall continue in full force and effect.
10. Waiver
10.1. No failure or delay by TWPayz in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.
